General Terms

Microstockr is the property of Microstockr SRL from here on referred to as "us", "we", "our".

The Microstockr app is a software program created to help microstock contributors track their sales over multiple agency websites. It will be referred to as "Service", "Software" or "Application".

"User" will refer to any individual or organization using the Service.

A microstock site or all entities allowing the sale of user media will be referred to as an "Agency".

We cannot be held accountable of any data loss, data interception, private information leaks or any damage incurred if the user downloaded the Software from any place on the web except our official website.

User Information & Communication

User Rights

The European Union through its law called the General Data Protection Regulation or "GDPR" gives certain rights to individuals in relation to their personal data. As available and except as limited under applicable law, the rights afforded to individuals are:

  • Right of Access - The right to be informed of and request access to the personal data we process about you.
  • Right to Rectification - The right to request that we amend or update your personal data where it is inaccurate or incomplete.
  • Right to Erasure - The right to request that we delete your personal data.
  • Right to Restrict - The right to request that we temporarily or permanently stop processing all or some of your personal data.
  • Right to Object - The right, at any time, to object to us processing your personal data on grounds relating to your particular situation. The right to object to your personal data being processed for direct marketing purposes.
  • Right to Data Portability - The right to request a copy of your personal data in electronic format and the right to transmit that personal data for use in another party’s service.
  • Right not to be subject to Automated Decision-making - The right to not be subject to a decision based solely on automated decision making, including profiling, where the decision would have a legal effect on you or produce a similarly significant effect.

Personal Information

Your privacy and security is of utmost importance.

Hence, by default, we do not store any of your microstock agency passwords on our servers, they are only stored in encrypted format on your local device. We're using 256 bit AES encryption as detailed in FIPS PUB 197.

What we do store on our servers are your Application account name, email, encrypted password(not agency passwords) and the Subscription expiry date. This information is needed to log you in and check the Subscription status. We also store, for the duration our Service is active, your agency usernames and emails associated with the Application email to prevent them being used on a new Application account and exploit the free trial period indefinitely. In case of account deletion this data will be anonymized by hashing.

Backups are only stored on your personal computer and will not be uploaded to our servers.

All transfers between your device and our servers are first encrypted by us using 256 bit AES encryption and then transmitted over the HTTPS protocol, effectively encryptying the information twice.

Communication

All communication between the Application and microstock agencies takes place without interruption or interception from our side. All communication and data exchanged is encrypted, including credentials such as usernames, emails and passwords used for logging into agencies.

Sales information received is by default stored only on your device.

With your consent we may use your email address to keep you posted on our latest product announcements, software updates and changes to our terms, conditions and policies. If you don't want to be on our mailing list, you can opt-out at any time by unsubscribing.

Sales, credential information and files provided by the user, received per our request on our support email for bug tracking purposes, will remain strictly confidential and will only be used to improve our Service.

Non-Personally Identifiable Information

Non-personally identifiable information is information that, by itself, cannot be tracked to a specific individual. Examples of non-personally identifiable information include, but are not limited to, log files, heat maps, aggregate data, device type, the type of internet browser you are using, the type of computer operating system you are using, the time and date of your use of our Service, and whether or not you clicked on hypertext links within the Service. We may collect non-personally identifiable information while you use the Service.

Use of Non-Personally Identifiable Information

We may use the non-personally identifiable information to generate user statistics that we may use to enhance your experience and create, develop, operate, deliver and improve our Service and content. If we provide any such information to others, we will provide such information in the aggregate only and will not include any personally identifiable information about any individual users. We may also use the non-personally identifiable information to generate statistics that we may provide to you and to other users using the Service.

Use of Cookies

Microstockr and our third-party analytics partners use cookies to ensure a seamless website and Application experience and also provide insights into user behavior. These insights help us improve our Service and provide performance analytics while collecting information about your online activities over time on our website and across different applications, and/or devices.

We use cookies in the following ways:


I. Strictly Necessary Cookies

These cookies allow us to operate the Microstockr Service as expected and are necessary for its proper functioning. For example, they let us recognise what your account login status is.


II. Performance / Analytics Cookies

These cookies collect information about how you use our Application and website — for instance, which pages you go to most, how many users are active at any moment or if you landed on the website from one of our marketing campaigns. This data may be used to help us optimize our website and Service and make them easier for you to use. These cookies don’t collect information that identifies you. All information these cookies collect is aggregated and therefore anonymous.


III. Third Party Cookies

These cookies are generated by the agency servers when you authenticate and they store your session ids so the Application does not have to log you in every time. They are stored on your local device in an aggregated form and are anonymous.

Suspension

An account is deemed inactive if no activity is registered in the past two and a half years(thirty months). The personal data associated with such an account will be anonymized and stored on our servers for the duration of our Service and used to prevent the exploitation of the free trial period by new users, as detailed above.

Payment

We do not collect any user payment information provided, such as credit card number, CVV/CVC number and expiry date. This is done by Braintree, a division of PayPal, Inc. and the payment gateway we use to process subscriptions. Any such information is stored on their dedicated servers and we cannot be held accountable for any personal information leaks or security breaches on the part of Braintree.
